1. Scope of Application
These Terms and Conditions (“Terms”) apply to all contracts concluded between Marco van Baal, Germany (hereinafter “Provider”, “we” or “us”) and the customer (hereinafter “Customer” or “you”) via the website my-digital-journey.com.
These Terms apply to both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). Deviating or conflicting terms of the Customer shall not be recognized unless expressly agreed in writing.
2. Subject of the Contract
The subject of the contract is the sale of digital products in the form of website templates and related digital content.
The products are provided exclusively in digital form via download or electronic transmission. No physical goods will be delivered.
3. Conclusion of Contract
The presentation of products on the website does not constitute a legally binding offer, but an invitation to submit an order.
By completing the order process and clicking the button labeled “Buy now” or similar, the Customer submits a binding offer to purchase the selected product.
The contract is concluded when:
- the Customer receives an order confirmation by email, or
- the digital content is made available for download immediately after payment.
4. Prices and Payment
All prices stated on the website are final prices.
According to § 19 UStG (German Small Business Regulation), no VAT is charged or shown.
Payment is due immediately upon conclusion of the contract.
The following payment methods are accepted: PayPal, credit card, Stripe, Apple Pay (or as displayed in the checkout process).
5. Delivery of Digital Content
Delivery is effected by providing a download link or access to the purchased digital content after successful payment.
The Customer is responsible for:
- providing a valid email address, and
- ensuring that emails from the Provider can be received (spam filter settings).
The Customer must ensure that the technical requirements (hardware, software, internet access) for using the digital products are met.
6. Right of Withdrawal (Consumers only)
Consumers generally have a statutory right of withdrawal.
Exception for digital content:
In accordance with § 356 (5) BGB, the right of withdrawal expires prematurely if:
- the Provider has begun executing the contract after the Customer has expressly agreed that the Provider may begin performance before the expiry of the withdrawal period, and
- the Customer has confirmed that they are aware that they lose their right of withdrawal once performance has begun.
Before completing the purchase, the Customer must expressly consent to the immediate delivery of the digital content and acknowledge the loss of the right of withdrawal.
If these conditions are fulfilled, the right of withdrawal does not apply.
A separate withdrawal policy is provided to the Customer during the ordering process.
7. Usage Rights and License
Upon full payment, the Customer is granted a non-exclusive, non-transferable right to use the purchased digital content.
Unless otherwise stated in the product description, the license permits:
- use for private and commercial purposes,
- use for unlimited projects or websites.
The Customer is not permitted to:
- resell, sublicense or redistribute the digital content,
- make the digital content available to third parties,
- publish or offer the digital content as their own product,
- use the digital content in a competing product or service.
Copyright and all intellectual property rights remain with the Provider.
8. Warranty and Liability
Statutory warranty rights apply.
In the event of defects, the Customer has the right to subsequent performance (rectification or replacement). If subsequent performance fails, the Customer may reduce the purchase price or withdraw from the contract in accordance with statutory provisions.
The Provider shall be liable without limitation for intent and gross negligence.
In cases of slight negligence, the Provider shall only be liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract.
Liability for injury to life, body or health and under the Product Liability Act (Produkthaftungsgesetz) remains unaffected.
The Provider does not guarantee that the digital products will meet the Customer’s individual expectations or achieve a specific result.
Refunds for Technical Issues
If you encounter technical issues with the purchased digital product, please contact our support at contact@my-digital-journey.com within 14 days of purchase. We will offer a refund or replacement if the issue cannot be resolved and is due to the product.
Refund Conditions
Refunds are granted only if:
- The product is defective and cannot be fixed by support.
- You contact us within 14 days with proof of the issue (e.g., error messages).
Non-Refundable Cases
Refunds will not be granted for:
- Change of mind or unmet expectations without technical issues.
- Use of the product on incompatible platforms/plugins not specified in the product description.
9. Liability
The Provider shall be liable without limitation for intent and gross negligence.

10. Storage of Contract Text and Contract Language
The contract text is not stored permanently by the Provider and is not accessible to the Customer after completion of the order.
The contract language is English.
12. Governing Law and Jurisdiction
These Terms and Conditions and all contractual relationships between the Provider and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the Customer is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction shall be the registered office of the Provider.
For consumers, statutory jurisdiction rules apply.
13. Final Provisions
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected.
The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
